Probate and estate planning is usually the last thing most people want to think about. It is also one of the most important things you should do. Not only does it protect your loved ones - it also:

I) Provides for an orderly disposition of your assets according to your wishes.
2) Minimizes tax consequences.
3) Allows you to provide input into what should happen if you are unexpectedly incapacitated.

At a minimum, everyone should have a will. This document directs the court as to the disposition of your assets. However there are several other ways in which to pass assets at your death. Some of these options are easily achieved outside of probate. This can substantially reduce the cost of probate and the time required to settle your estate.

Additionally, there are other documents most people should have in place. Which documents you need should be determined by your personal circumstances. Frequently, these documents include some combination of a medical power of attorney, a general durable power of attorney, a living will, a living trust and a transfer on death deed. If you have minor children you should address their needs should anything happen to you.
